      <image:title>St Barnabas Church - Alpha Planning was asked to prepare a report on behalf of the PCC in order to demonstrate that the building was not of such special architectural or historic interest that it was worthy of listing.</image:title>
      <image:caption>Effectively our report, which was shared with the Diocesan Advisory Committee and Chancellor, was the equivalent to one that would be prepared for a non-ecclesiastical building in order for a certificate from the Secretary of State to be issued stating that the building would not be listed (Section 6 of the Planning [Listed Buildings and Conservation Areas] Act 1990).  This process was successful which paved the way for the subsequent relocation of the church.</image:caption>

      <image:title>Beechwood Court - In Farnham Royal, our client owns a large site with a variety of buildings and uses on the site, but it is located within the green belt. One of the buildings was an office building that our client wanted to extend. However, national and local policy indicate that such development would be inappropriate development within the green belt.</image:title>
      <image:caption>Having considered the needs of our client and the character of the building, which had been built around a large enclosed courtyard, we were able to advise that it should be possible to infill the courtyard, creating a roof over it, without the requirement to submit a planning application.  Section 55 of the Planning Act sets out what constitutes development, noting that improvement or other alteration of any buildings involving works that affect only the interior of the building, or do not materially affect the external appearance of the building do not involve development. In order to provide our client with the certainty that he required we submitted a Certificate of Lawful Proposed Development to the Council, who confirmed that the infilling of the courtyard did not require planning permission and consequently our client was able to increase the internal floor area of the building by 320sqm.</image:caption>

      <image:title>Taplow - Our client owns a 1.25ha horticultural nursery in the green belt which, over the years, has used permitted development rights to erect agricultural buildings. The buildings have been used for wholesale and retail sale of products associated with the nursery, and we obtained planning permission for the sale of a greater range of ancillary goods than those produced on site.</image:title>
      <image:caption>However, the occupier introduced sales unrelated to that permission and subsequently the local planning authority took enforcement action against the unauthorised activities.  We won on appeal, and the Inspector concluded that the activities on site represented a mixed use rather than an agricultural use.   Following this success on appeal, we have made representations to the Council’s ‘call for sites’, green belt assessment and their emerging local plan, advocating the removal of the site from the green belt (together with two adjacent sites – total area 3.7ha). This outcome was successful, and the area was taken out of the green belt.</image:caption>
